Official Rules

The Rospeed Imports Giveaway shall only be interpreted and evaluated under U.S. law, Canadian law, and any applicable state or provincial law and is only open to legal residents of the United States of America (USA) or Canada. If you are not a resident of the USA or Canada at the time of entry, do not enter this Giveaway. Entrants acknowledge that these Official Rules and the Sponsor's decisions, which are final and binding in all issues relating to the Giveaway, are binding upon them by their participation. Meeting all requirements outlined below is a requirement for winning the Prize (as described below).

SPONSOR: The Giveaway is sponsored by RodSpeed Imports Inc, 13530 Northwest 107^th Avenue, Hialeah Gardens, FL 33018.

ELIGIBILITY: To be eligible to enter the Giveaway, you must be a legal United States or Canada resident at least 18 years old or have reached the age of majority in your respective state or province of permanent residence at the time of entry. However, employees, officers, and representatives of the Sponsor, the Administrator, their respective parent companies, advertising, and promotional agencies, as well as immediate family members or individuals residing in the same household as these individuals, including biological, adoptive, and step-parents, grandparents, siblings, children, and grandchildren, are not allowed to participate in the Giveaway. Please meet the eligibility criteria or comply with any of the rules stated in this document to avoid disqualification. This giveaway is invalid in Puerto Rico, U.S. territories, and locations where it is prohibited or limited by law. (To make it clear, any mentions in these regulations of "Entrants" also refer to the winning entrant as defined below.)

WAYS TO ENTER: There are two ways to participate in the Giveaway, which runs until RSIG 5 is 100% filled. The official time-keeping device for the Giveaway is the Sponsor's computer.

The first way to enter is: by making a purchase on the Rodspeed Imports online store, with each $1 you spend on merchandise will get you 1 entry for a chance to win (Excluding tax and shipping). Until campaign merchandise get sold out, online entries must be received at 11:59pm (PT) on the last day announced. The second way to enter is by becoming a RodSpeed Imports subscriber during the Giveaway Period or buying some Sponsor products using the Website to claim additional prizes unrelated to the Giveaway. Entrants must make online entries at the Website, and any entries made by other individuals or entities or through automated entry devices or mechanically reproduced entries, will be disqualified.

Fraudulent activity, including purchasing items to obtain entries and intending to return them after the promotion, is strictly prohibited and will result in disqualification and banning from any other Giveaway or promotions offered by the Sponsor.

The second way to enter is: During the Giveaway Period, eligible participants can enter by hand-printing their full name, complete mailing address, phone number, date of birth, and email address on a 3"x 5" card or paper and mailing it in a #10 business-sized envelope with proper postage affixed to 13530 Northwest 107th Avenue, Hialeah Gardens, FL 33018. (the "Mail-In Entry"). The envelope must be postmarked and received before 100% filled. Each mail-in entry will be worth one entry in the Giveaway. Entrants must hand-print the entry card and envelope themselves and cannot use third-party organizations to assist in the entry process. Each envelope must be mailed individually, and bulk shipments of entries will not be accepted. Confirmation of receipt of mail-in entries will not be provided. Enters' personal information will be treated according to the Sponsor's privacy policy, available at https://rodspeedimports.com/policies/privacy-policy. By participating in the Giveaway and providing personal information, entrants agree to the Sponsor's collection and usage of their knowledge and acknowledge having read and accepted the Sponsor's Privacy Policy.

Bonues Entries: This text describes how participants can earn bonus entries in the Giveaway. The Sponsor may announce Bonus Entry Periods on their website or social media pages, offering opportunities to earn additional entries, such as 6X, 15X, or 25X entries. The Sponsor will determine these periods. Incomplete entries or entries received after the deadline will be disqualified. The Sponsor is not responsible for any issues with late, incomplete, incorrect, delayed, or misdirected entries. All entries become the property of the Sponsor and will not be returned. By participating, participants agree to allow the Sponsor to use their personal information to administer the Giveaway and other purposes as set forth below.

RELEASE AND LIMITATIONS OF LIABILITY: When entering the Giveaway, Entrants agree to release and not hold liable the Sponsor, YouTube, and Administrator (together called the "Released Parties") for any claims or legal action that arise from participating in the Giveaway or using the Prize, including but not limited to

1. Any technical difficulties preventing entry submission,
2. Unauthorized human intervention in the Giveaway,
3. Printing mistakes,
4. Errors in administration or entry processing, or
5. Injury, death, or property damage resulting directly or indirectly from participating in the Giveaway or winning the Grand Prize (defined below).

The Released Parties will not be held responsible for any error, omission, deletion, interruption, defect, delay in operation or transmission, communication line failure, theft, destruction, or unauthorized access to, or alteration of, entries. The Released Parties are also not responsible for any technical malfunctions with telephone networks or lines, computer systems, servers, providers, equipment, software, or any email or entry failure due to technical problems, human error, or internet congestion. Entrants agree that in any legal action, the Released Parties' liability will only be up to the cost of participating in the Giveaway. They will not be responsible for attorney fees or punitive, consequential, direct, or indirect damages. However, for New Jersey residents, recovery of damages or attorney fees may be mandated by statute.

Apart from what has been clearly stated above, the Released Parties will not be held accountable or liable for any losses or damages of any sort, including direct, indirect, incidental, consequential, or punitive damages, that may arise from participating in this Sweepstakes or from accepting, possessing, using, or misusing a Prize. By taking part in this Giveaway, Entrants agree to release and indemnify the Released Parties from any liability for injuries, death, or losses or damages to persons or property, as well as for claims or actions based on defamation, invasion of privacy, or publicity rights that may arise from participating in this Sweepstakes or its related activities or from accepting, possessing, using or misusing a Prize. Suppose any part of the Giveaway is canceled due to weather, fire, strike, acts of war or terrorism, pandemic, or any other condition beyond their control. In that case, the Released Parties are not responsible.

RELEASE OF CLAIMS (CALIFORNIA): The Entrant understands and accepts that there may be a chance that they may become aware of unforeseen claims after agreeing to these Official Rules and participating in the Sweepstakes, which could have influenced their decision to enter. The Entrant agrees that they are taking on any potential risk associated with such unknown claims. The Entrant is aware of the contents of these Official Rules and has been informed of Section 1542 of the California Civil Code, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would materially affect his or her settlement with the debtor or released party.” 

Entrants expressly waive any and all rights under California Civil Code Section 1542 and under any other federal or state statute or law of similar effect.

GENERAL CONDITIONS: Suppose the operation or administration of this Giveaway is hindered or unable to proceed as intended due to reasons such as computer viruses, tampering, fraud, technical difficulties, or any other causes outside of the Sponsor's control that can corrupt or impact the administration, fairness, security, integrity or proper conduct of this Giveaway. In that case, the Sponsor has the right to disqualify any individual who tampers with the entry process and to cancel, terminates, modify, or suspend the Giveaway in whole or in part, at any time, without any prior notice. The Sponsor also reserves the right to award the Prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification, or suspension date, or in any way that is fair and conforms to the spirit of these Official Rules. The Sponsor may disqualify any individual who attempts to tamper with the entry process or the operation of the Giveaway or Sponsor's Website, or who is acting in violation of these Official Rules or in a disruptive or unsportsmanlike manner.

Be warned that intentionally causing harm to a website or attempting to interfere with the lawful operation of the Giveaway is illegal and can result in criminal and civil penalties. If anyone tries to cause such harm, the Sponsor has the right to seek damages or other legal remedies from those responsible to the extent permitted by law.

If the Sponsor doesn't enforce any provision of these Official Rules, it doesn't mean they waive their right to enforce that provision in the future. Suppose there is a dispute about the identity of a Winner based on their email address. In that case, the Sponsor will consider the entry to be from the person assigned that email address by their Internet or online service provider or other organization responsible for assigning email addresses for that domain. This person is known as the "authorized account holder".

DRAWING AND NOTIFICATION: The Administrator, an impartial organization in charge of the Giveaway, will conduct the Prize drawing. The decisions made by the Administrator are final, and the drawing announcement date/time announced via social media & website once 100% full. The odds of winning the Prize depend on the number of eligible entries received during the Giveaway Period. The Administrator will inform the potential Prize Winner via phone, email, and/or USPS mail or any other delivery method chosen by the Sponsor.

Be aware of fraudulent activities! If you are chosen as a potential winner of the Giveaway, RodSpeed Imports Inc will contact you by phone. Do not disclose any banking or credit card information or make any payments as a requirement for receiving your prize. Remember, winners, are never notified via social media. Please be aware of fake pages.

 You can file a complaint with the FTC at www.Reportfraud.ftc.gov or by calling 877382-435.

PRIZE: After confirming eligibility, the Administrator will award a Car or Cash to one winner. The award includes a pre-owned 1992 Honda civic Awd hatchback 850whp, with an approximate retail value of USD $35,000 plus $3,000 Cash or $35,000 cash. The total value of the prize is $40,000 USD. The Second Place wins USD $1,000.00, the 3rd Place wins USD $500.00, the 4th Place 75 Free Entries for the next Giveaway, and the 5th Place USD $50 Gas Gift Card.  

All expenses for the Winner's travel to Miami, FL, to claim the Prize will be covered by RodSpeed Imports. The Prize must be claimed within 15 days of the Winner's approval, and the Winner is also required to title the vehicle within 15 days of receiving the title and the car.

The Prize will be delivered to the Winner "AS IS," and any upgrades or additional options will be the sole responsibility of the Winner. The Sponsor is not liable for any warranty, representation, or guarantee expressed or implied, in fact, or law, regarding the vehicle's quality, fitness for purpose, or mechanical condition. The Winner must possess a valid U.S. driver's license from their state of residence to receive the vehicle. Provide this documentation to avoid prize forfeiture and the selection of an alternate winner. The Winner is responsible for all optional equipment, title, license, insurance, and registration fees required to claim the vehicle, as well as all other expenses related to the use of the car, including any travel and transportation costs associated with collecting the vehicle. All additional fees not explicitly stated as being awarded are the responsibility of the Winner. Before taking delivery, the Winner may be required to show proof of insurance and pick up the vehicle as directed by the Sponsor. The Sponsor is not responsible for any warranty, representation, or guarantee, expressed or implied, in fact, or law, regarding any prize, offered in this Giveaway, including the quality, mechanical condition, or fitness for a particular purpose of the prize vehicle. The Winner is responsible for ensuring that the prize vehicle meets any safety or emissions testing requirements in their state, province, territory, county, or municipality and must use the car in accordance with those regulations. In the event that the announced Prize becomes unavailable, the Sponsor reserves the right to substitute a prize of equal or greater value.

PRIZE CONDITIONS: The Prize Winner must agree to release and not hold the Released Parties, their related companies, officers, directors, employees, shareholders, and agents liable for any claims or causes of action arising from participation in the Sweepstakes or the use of the Prize. The potential Winner must sign and return to the Administrator an Affidavit of Eligibility and Liability/Publicity Release (for U.S. residents) or a Declaration of Compliance (for Canadian residents) within five days of receiving notice in order to claim the Prize. The Affidavit will require the Winner to provide their Social Security Number for tax purposes. The Winner is responsible for all local, state, and federal taxes related to the Prize, which will be considered taxable income, and the IRS will file a Form 1099 in the Winner's name. After receiving the Prize, the Winner is solely responsible for all related matters. If a Prize or notification is returned unclaimed or undeliverable, or if the potential Winner fails to comply with the rules, an alternate Winner may be selected at the Sponsor's discretion.

For Selected Canadian Winner: The chosen participant in the Giveaway must solve a mathematical skill-testing question correctly without any assistance, whether mechanical, electronic, or otherwise. Answer the question correctly to avoid disqualification, and a new participant will be randomly selected. If the potential winner is below the age of majority in their province of residence, they will be disqualified, and a new winner will be chosen. The winner will be contacted by phone, mail, or email at the Sponsors' discretion, using the contact information provided during entry. The winner agrees to allow the Released Parties to use their name, image, voice, and biographical data for advertising and promotional purposes without further compensation if permitted by law. By participating in the Sweepstakes, entrants agree to release and hold harmless the Released Parties from any liability for injuries, death, or damages to persons or property. The winner also acknowledges that the Released Parties are not responsible for any warranty, representation, or guarantee relating to the prize, express or implied, in fact, or law.

DISPUTES: By participating in the Giveaway, Entrants agree to the following terms:

1. Any disputes or claims arising from the Giveaway or prizes awarded will be resolved individually, without any class action.
2. Any claims, judgments, and awards will be limited to the actual costs incurred, including the costs associated with entering the Sweepstakes, but not including attorney fees.
3. Entrants waive all rights to punitive, incidental, consequential, or any other damages except out-of-pocket expenses.

The validity, interpretation, and enforceability of these Official Rules and the rights and obligations of Entrants, Sponsors, and Released Parties shall be governed by United States law, specifically the law of Florida. Any legal proceedings related to the Giveaway or these Official Rules must be held in federal or state courts in Clearwater, California. The other provisions will remain in effect if any provision of these Official Rules is deemed invalid or unenforceable.

SEVERABILITY: If any part of these Official Rules is found invalid or unenforceable, it will not affect the validity or enforceability of the remaining parts. The other provisions will still be in effect and interpreted as if the invalid or unenforceable part was not included in these Official Rules.

MISCELLANEOUS: This set of rules represents the complete and final agreement regarding the Sweepstakes and overrides any prior written and oral agreements. The section headings are included for convenience and do not affect or limit the provisions of the rules. Any changes or waivers of the rules must be made in writing and signed by both the Sponsor and Administrator. The release of any rule by the Sponsor or Administrator does not waive any other provision. The Entrant cannot transfer their rights and responsibilities under regulations without the written consent of the Sponsor, and any such attempt is null and void. These rules are binding for both the Sponsor and Administrator and the Entrant and their permitted successors and assigns.

This Giveaway is not sponsored, endorsed, or administered by any social media platforms, search engines, tech companies, or prize manufacturers. None of these entities have endorsed or recommended this Giveaway in any way.
